Who can claim?

Only Australian residents (excluding NT) who:

  1. are aged 18 or over; and
  2. are a valid Dan Murphy's My Dan's loyalty program member at the time of claiming (and have a valid My Dan's membership number).

Employees of the Promoter (and their immediate families) who satisfy the above criteria can also participate, and claim, in this offer.

The offer will run in participating Dan Murphy's outlets (including online at www.danmurphys.com.au) in Australia (excluding NT) (Outlets).

Qualifying Purchase

Spend $550 or more on any Penfolds wines (excluding Cellar Release, Fortified, Koonunga Hill, Max's and 375ml range) in one transaction from an Outlet (Qualifying Purchase) to receive a gift, while stocks last.

The value of your Qualifying Purchase will determine which Tier Gift you may be eligible to claim (as outlined below in the 'Gifts' section), while stocks last. Specifically:

Proof of purchase: You must retain proof of purchase. The proof of purchase required is the original itemised purchase receipt of the Tier 1, Tier 2 or Tier 3 Qualifying Purchase.

Claim instructions

To claim, you must:

  1. during the Purchase Period, make a Qualifying Purchase from an Outlet; and
  2. during the Claim Period, visit the Website, locate the claim page, and fill out and submit the claim form, including by selecting your preferred colour of gift, uploading an image of your itemised Qualifying Purchase receipt, providing your My Dan's membership number, and providing all other requested information (including your address and email address).

Please allow up to 5 business days for the Promoter to validate your claim from and receipt.

You will then receive confirmation via the email on your claim form within 5 business days of validation by the Promoter. You must review the details (e.g. address) in that confirmation email are correct. Once you confirm those details, you will receive SMS tracking information from the Promoter within 10 business days.

You acknowledge gifts are subject to availability, and that the Promoter won't be liable if you don't get your preferred colour selection for your gift.

Any claims for gifts outside the Claim Period will not be accepted.

Your purchase receipt must clearly identify where the Qualifying Purchase was made, the product/s purchased (which must be/comprise of a Qualifying Purchase), and the date of purchase (which must be during the Purchase Period).

The Promoter is not responsible if your mobile device/desktop is not sufficiently capable for the purpose of submitting a claim, including having the requisite photograph capability.

Gifts

There are in total 260 gifts available for this offer – 120 x Tier 1 gifts, 60 x Tier 2 gifts and 80 x Tier 3 gifts.

Gifts are available while stocks last. This offer will run on a first-in-first-served basis for those who make the relevant Qualifying Purchases, submit their claim and receive confirmation that their claim has been verified. Allow up to 5 business days for verification.

If you are a successful claimant you may be able choose which colour of gift you prefer, subject to availability, during the claim process. The Promoter won't be liable if you don't get your preferred colour selection.

How many times can I claim?

You can claim up to 2 gifts per person and up to 4 gifts per household in total for the duration of this offer.

For clarity, if you can claim more than 1 gift due to the value of your Qualifying Purchase spend, you must clarify which gift/s you would like (for example, 2x Tier 1 Gifts or 1x Tier 1 Gift and 1x Tier 3 Gift (Subject to claim requirements and gift availability).

Each claim must be submitted separately in accordance with these Terms and Conditions.

How and when will successful claimants be informed?

Successful claimants will receive an email confirming their claim within 5 business days of validation, and an SMS with gift tracking information within 10 business days of that confirmation email.

Allow up to 10 business days for shipping following receipt of the tracking SMS.

Proof of purchase

You must keep your original itemised purchase receipt(s) as proof of purchase for all claims.

If you don't produce the above proof of purchase for all claims when asked, the Promoter may disqualify all of your claims and you will lose any right to a gift.

Proof of purchase must be identical to that provided by you with your claim.

If, in the Promoter's opinion based on the available information, you have shared any proof of purchase with another person, your claims will be invalid and you will lose any right to a gift.

Receipts must not be tampered with or manipulated/altered in any way. If, the Promoter reasonably suspects, based on the information available, that a receipt may be tampered or altered/manipulated, you will be asked for further information to allow the Promoter to validate your receipt. If the information you provide does not establish the validity of your receipt (to the Promoter's reasonable satisfaction) or you fail to provide such information in the timeframe reasonably requested, the Promoter may invalidate your claim.

Collection and use of your personal information

The Promoter may collect your personal information (including through its contractors or agents) and disclose your personal information to its contractors and agents to assist in conducting this offer or communicating with you. This may include disclosures to organisations outside Australia, in accordance with the Promoter's privacy policy, including to the United States of America, United Kingdom, People's Republic of China or Singapore.

By claiming, you consent to receive email or SMS messages from the Promoter without any functional unsubscribe facility if they relate primarily to the conduct of this offer.

  1. how you can seek access to the personal information the Promoter holds about you and seek the correction of such information; and
  2. how you can complain about a privacy breach and how the Promoter will deal with such a complaint.

You acknowledge that Dan Murphy's may need to process personal information about you in order to facilitate you Qualifying Purchase. Dan Murphy's privacy practices are outside of the Promoter's control, and you must ensure you familiarise yourself with them prior to proceeding.

Claim

  1. Your claim for redemption must be received during the Claim Period, and will be deemed to be received only when received by the Promoter. If you return a Qualifying Purchase your claim may be deemed invalid at the Promoter's discretion (unless the product is defective). You will receive a return message confirming your claim. The Promoter is not liable for any problems with communications networks outside its reasonable control. You are responsible for your own costs associated with claiming. If you claim using automatically generated claims or multiple phone numbers/email addresses/addresses/aliases, you may be disqualified.

Gifts

  1. Gifts and all elements of gifts must be taken as specified, as and when offered and cannot be altered or changed in any way by you or will be forfeited, and if forfeited, the Promoter will not be liable. If you forfeit the gift or any element of the gift for whatever reason, you will not be given cash or any alternative gift as a substitute. Gift/s are subject to any additional terms and conditions imposed by the relevant supplier or the Promoter.
  2. The Promoter is not responsible for any dispute between you and any person with whom you choose to, or choose not to, share a gift.

General

  1. Any material failure by you to comply with the conditions imposed by the gift supplier(s) may result in the gift being cancelled or withdrawn without liability for the Promoter or the gift supplier(s).
  2. If you or your claim are deemed by the Promoter to breach these Terms and Conditions materially your claim (or at the Promoter's discretion, all of your claims) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's reasonable satisfaction the validity of your claims and/or verifying your identity (including documentation establishing your identity, age, place of residence and place of employment). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  3. You must not:
    1. tamper with the claim process (including but not limited to manipulating the system via bots, script use, or any other means to circumvent the claim process);
    2. engage in any conduct that may jeopardise the fair and proper conduct of the offer;
    3. act in a disruptive, annoying, threatening, abusive or harassing manner;
    4. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this offer;
    5. breach any law; or
    6. behave in a way that is otherwise inappropriate.
  4. If you in the reasonable opinion of the Promoter (and/or a medical professional, as relevant to the circumstances), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this offer, is contrary to law or is otherwise inappropriate, the Promoter may cancel the gift or restrict you from participating in any elements of the gift, at its discretion.
  5. The Promoter is not liable for gift claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted for reasons outside the Promoter's reasonable control.
  6. If any dispute arises between you and the Promoter concerning the conduct of this offer or claiming a gift, the Promoter will take reasonable steps to consider your point of view, taking into account any facts or evidence you put forward, and to respond to it fairly within a reasonable time. In all other respects, the Promoter's decision in connection with all aspects of this offer is final.
  7. Gifts cannot be transferred or exchanged nor redeemed for cash. Without limiting any other term of these Terms and Conditions, all gifts (and elements of gifts) must be taken as and when specified, or will be forfeited with no replacement. The gift values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in gift value. You agree that if a gift (or element of a gift) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
  8. If this offer cannot run as planned for any reason beyond the Promoter's control (for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, government directives, a pandemic, public health orders and the like), the Promoter may end, change, suspend or cancel the competition or disqualify affected claims/claimants, subject to any necessary approval by the state/territory gaming authorities.
  9. The Promoter is not responsible for any tax implications arising from you winning a gift. You should seek independent financial advice. If for GST purposes this offer results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

Liability

  1. You may have consumer rights under statute including under the Competition and Consumer Act 2010 (Cth), which may be relevant to any issue or problem you encounter in relation to this offer and cannot be excluded or restricted. Nothing in these Terms and Conditions excludes or restricts those rights. See www.accc.gov.au for more information about those rights.
  2. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this offer are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury(including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any gift, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  3. Without limiting the previous paragraphs, the Promoter and the agencies and companies associated with this offer are not liable for any loss of, damage to or delay in delivery of gift/s, or for any damage that occurs to displayed gift/s (where relevant), due to circumstances beyond the Promoter's reasonable control. Unless otherwise specified, gift/s will only be delivered to addresses in Australia.
  4. This offer is in no way sponsored, endorsed or administered by, or associated with any social media platform, including Facebook, Instagram and X. You provide your information to the Promoter and not to any social media platform. You completely release any relevant social media platforms from any and all liability.
